2. Orders & Payment
All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that appear to be fraudulent, abusive, or in violation of these terms.
You agree to provide current, complete, and accurate purchase and account information for all orders placed on our website.
3. Shipping & Delivery Policy
Once an order has been shipped and accepted by the carrier, responsibility for the shipment transfers to the customer. We are not responsible for loss, damage, or delays caused by the carrier during transit.
For added protection, customers may choose to purchase shipping insurance at checkout, where available.
We are not responsible for claims of non-receipt when the carrier’s tracking information confirms that the order was delivered to the shipping address provided by the customer. For shipments sent with signature confirmation, the carrier’s delivery confirmation and recorded signature constitute proof of delivery and fulfillment of the order.
For high-value orders, we may require signature confirmation upon delivery. In such cases, delivery confirmation provided by the carrier is considered final.
4. Delivery Issues, Claims & Investigations
If a delivery issue is reported, the customer is responsible for contacting the carrier directly to initiate any delivery investigation or claim. We will cooperate fully with the carrier or relevant authorities and provide any documentation required, including proof of delivery and shipment records.
If the customer believes an order was stolen after confirmed delivery, the customer may choose to file a police report. Theft of delivered merchandise is treated seriously under applicable law, and carriers such as UPS may work with law enforcement authorities during investigations.
5. Risk of Loss & Title
Title to and risk of loss for items pass to the customer upon acceptance of the shipment by the carrier, unless otherwise required by applicable law.
6. Refunds, Returns & Chargebacks
Refunds or replacements will not be issued for orders marked as delivered by the carrier, including deliveries confirmed by signature.
Any attempt to initiate a chargeback for an order confirmed as delivered may be contested by us using carrier documentation, delivery confirmation, and signature records where applicable.
Customers agree to contact us directly to attempt to resolve any issue prior to initiating a chargeback or payment dispute.
7. Fraud Prevention
We reserve the right to investigate and report suspected fraudulent activity, including but not limited to false claims of non-receipt, abuse of chargeback processes, or misuse of payment methods. We may share relevant transaction and delivery information with payment processors, carriers, financial institutions, and authorities as required.
8. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, punitive, special, or consequential damages arising from the use of our website or products, including but not limited to delivery issues beyond our control.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida without regard to conflict of law principles. Any legal action, claim, or proceeding arising out of or relating to these Terms of Service, the use of this website, or any purchase made through the website shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum or lack of jurisdiction.
